Charges against murder suspect dropped

Circuit Court Judge Larry Anderson today dismissed murder charges against a Dothan man who allegedly shot another man in the back of the head during a drive-by shooting.

The 26-year-old defendant was arrested in late 2008 in connection with the Christmas Day 2005 shooting of 41-year-old Gene Nichols.

His capital murder trial was slated to begin next week but the judge unexpectedtly granted a request from the proseuction that the murder charges be dropped. Doug Valeska, the Houston County District Attorney, said that the charges had become much more difficult to prove following the two eye witnesses to the shooting recanting their stories.

While the murder charges were dismissed, the defendant will still be serving a 12 year minimum sentence for an unrelated drug distribution conviction.
