DWI elevated to felony with child in vehicle

Montgomery County officials recently arrested a mother driving with her 1-month old baby for drunk driving.

According to the Montgomery County Assistant District Attorney, “What would ordinarily be a misdemeanor crime is automatically elevated to a serious felony crime simply because a child was in the car.”

Police reports indicate that an officer found the mother sitting in her car at a traffic light on The Woodlands Parkway. ¬†The traffic light was reported to have changed several times, but the woman’s vehicle never moved.

The mother was reportedly asked to get out of the car but could barely stand up.  Furthermore, the child was said to have not been properly restrained in the back seat.
